Private Job Terms

These Terms apply when an individual uses Birdly to post a Private Job for matching with businesses.

Unlike the paid Birdly Subscription, this part of Birdly may be used by consumers.

Please read these Terms before submitting a job.

1. Who operates Birdly?

Birdly is an online matching/intermediary service.

2. What Birdly does

You can describe a job you want carried out. Birdly uses information such as type of work, area, timing, job details and business services/coverage to identify potentially relevant businesses.

Birdly's role is to help create contact.

3. Birdly is not the contractor

Birdly does not carry out the work and is not a party to the contract between you and any business you choose.

The business — not Birdly — is responsible for its quote, price, tax/VAT position, availability, qualifications, insurance, workmanship, timing, guarantees, statutory duties and actual performance.

You and the business agree the work directly.

4. Free for the person posting the job

Birdly does not charge you simply for posting a Private Job and being matched under the standard flow.

Birdly does not take commission from the price separately agreed with the business, unless a future different arrangement is clearly shown before use.

The business may pay Birdly for its own Subscription.

5. How your job is shared

Your job description, general area and relevant non-contact details may be shown to matched businesses.

If you upload photos, they may be shown to matched businesses so they can assess relevance.

Under Birdly's standard model:

The live product and these Terms must match. If the flow changes, update these Terms.

6. Your contact details

When you submit a job, you authorise Birdly to use/share information reasonably necessary to provide the requested matching service, which may include name, mobile, email and address/more precise location where required.

Birdly will explain in the form when those details are shared.

Once an independent business receives your contact details, it is responsible for its own use under applicable data protection law.

If you want a business to delete information already received, you may need to contact that business directly.

7. Photos and job content

Upload only relevant photos. Avoid faces where unnecessary, identity documents, financial/medical information, images of children, and content you do not have the right to share.

Birdly may remove content that appears unlawful, unsafe, irrelevant or in breach of these Terms.

Job photos are stored with access controls and deleted/anonymised under the Privacy Policy. Intended standard: no later than 30 days after a job is closed, subject to legal/security retention needs.

8. Businesses are independent

Birdly matches businesses using information such as trade/service and area.

Unless Birdly expressly says otherwise for a specific check, Birdly does not certify workmanship, guarantee competence, guarantee insurance, guarantee financial standing, guarantee licences/accreditations, inspect previous work or guarantee reliability.

Birdly does not endorse a business simply because it appears as a Match.

You should make your own checks. Depending on the work, these may include references, reliable reviews, insurance, qualifications, regulated licences/registrations, written quote, scope and payment terms.

Do not describe Birdly businesses as vetted, approved, trusted or verified elsewhere on the UK site unless Birdly genuinely performs the relevant check.

9. No obligation to hire

Posting a job does not require you to accept a quote, reply to every business or appoint anyone.

10. Your responsibilities

You confirm that information is accurate to the best of your knowledge, you are entitled to arrange the work, the job is lawful, and your content does not infringe rights.

Do not use Birdly to post fake jobs, obtain contact details for unrelated purposes, commit fraud, sell illegal goods/services, facilitate unlawful activity or harass anyone.

You must be at least 18 years old to post a Private Job.

11. Quotes, contracts and payment

Any quote/estimate/price comes from the business, not Birdly.

Before agreeing work, check scope, exclusions, VAT, materials, timing, payment stages, cancellation terms and guarantees.

Any work contract is between you and the business. Your legal rights against the business are not replaced by Birdly's Terms.

12. Problems with a business

Raise work problems with the business first and use applicable complaints, trade-body, ADR or legal routes.

Birdly is not the contractor and cannot decide a contractual dispute between you and the business.

If you believe a business is fraudulent, seriously misleading, using Birdly unlawfully, harassing users or creating a safety risk, report it to support@birdly.dk.

Birdly may investigate platform misuse and suspend/remove a business where appropriate. This does not mean Birdly accepts responsibility for the underlying work.

13. Job duration

A Private Job remains active for the period shown in confirmation/job page. You may close/resolve it earlier.

If nobody takes the job, Birdly may close the listing, allow update/repost, or ask whether you still want it active.

14. Liability and consumer rights

Birdly is not responsible for work performed by an independent business or that business's acts, omissions, quote, pricing, delay, workmanship or breach.

Birdly does not guarantee that a business will respond, that you will get 3 responses, any quote, an acceptable quote or a suitable business.

Birdly remains responsible for its own obligations to the extent required by law.

Nothing excludes or limits mandatory consumer rights, liability for death/personal injury caused by negligence where non-excludable, fraud/fraudulent misrepresentation, or another liability the law does not allow Birdly to exclude/limit.

Nothing removes rights you may have against the independent business under consumer law.

15. Personal information

Birdly processes personal information under the Privacy Policy. Once a matched business receives your information, that business may be an independent controller for its own processing.

16. Changes

Birdly may update these Terms. The version applying when you submit a job will be available online.

If a material change affects an active job, Birdly will normally apply the version in force at submission unless a change is required by law or clearly beneficial to you.

17. Governing law and mandatory consumer rights

These Terms are governed by Danish law.

However, if you are a UK consumer, this does not deprive you of mandatory consumer protections that apply and cannot lawfully be excluded.

Nothing requires you to give up a right to bring proceedings in a court that applicable mandatory law entitles you to use.
